General Terms and Conditions (AGB)<\/h1>\n

Arvid Polak Motorsport – Online-Reifenhandel<\/strong>
Status: June 2025<\/p>\n

1. scope of application<\/h2>\n

\n These General Terms and Conditions (GTC) apply to all orders placed<\/a> by consumers and entrepreneurs via our online store at
\n https:\/\/www.apmotorsport.de.\n <\/p>\n

\n A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes
\n that are predominantly outside their trade, business or profession (Section 13 BGB).
An entrepreneur is any natural or legal person or partnership with legal capacity,
\n who, when concluding a legal transaction, acts in the exercise of their commercial or self-employed activity (Section 14 BGB).\n <\/p>\n

3. conclusion of the contract<\/h2>\n

\n The presentation of the products in the online store does not constitute a legally binding offer, but an invitation to place an order.
\n By clicking on the \u201cBuy now\u201d button, the customer submits a binding offer to purchase the products in the shopping cart.
\n Confirmation of receipt of the order is sent automatically by e-mail and does not constitute acceptance.
\n The purchase contract is only concluded by our express declaration of acceptance or by the dispatch of the goods.\n <\/p>\n

4. registration for dealers<\/h2>\n

\n Commercial resellers can register as retailers<\/strong>. Proof of commercial activity is required
\n (e.g. VAT ID or trade license). After successful verification, access to the retailer area with individual conditions will be activated.
\n There is no entitlement to registration.\n <\/p>\n

5. prices and payment methods<\/h2>\n

\n All prices quoted include VAT (for consumers) and do not include shipping costs.
\n Dealer prices are shown as net prices after activation.\n <\/p>\n

The following payment methods are available:<\/p>\n

  • Prepayment by bank transfer<\/li>\n
  • Cash payment on collection (by arrangement)<\/li>\n<\/ul>\n

    6. shipping conditions<\/h2>\n

    \n Delivery is currently made to the following countries:
    Germany, Austria, France, Italy, Croatia, Netherlands<\/strong>\n <\/p>\n

    \n Unless otherwise stated, the delivery time is 3 to 7 working days after receipt of payment.
    \n The shipping costs are shown separately in the order process.\n <\/p>\n

    7. reservation of title<\/h2>\n

    \n The goods remain our property until full payment has been made.
    \n In the case of entrepreneurs, we reserve title to all goods until all claims arising from the business relationship have been settled in full.\n <\/p>\n

    8. right of withdrawal for consumers<\/h2>\n

    \n Consumers are entitled to the statutory right of withdrawal. The details, including a sample withdrawal form, can be found on the website
    \n under \u201cRight of withdrawal\u201d. There is no right of withdrawal for entrepreneurs.\n <\/p>\n

    9 Warranty and liability<\/h2>\n

    \n The statutory warranty provisions (24 months) apply to consumers.
    For entrepreneurs, the warranty period is 12 months from receipt of the goods.\n <\/p>\n

    \n We shall be liable without limitation for intent and gross negligence. In the event of simple negligence, we shall only be liable for breach of material contractual obligations
    \n and limited to the foreseeable, typically occurring damage.\n <\/p>\n

    10. online dispute resolution and consumer dispute resolution<\/h2>\n

    \n The EU Commission provides a platform for online dispute resolution (OS):

    We are not obliged and not willing to participate in a dispute resolution procedure before a consumer arbitration board.\n <\/p>\n

    11 Contract language and storage<\/h2>\n

    \n The contract language is German. The complete text of the contract is not stored by us.
    \n Before submitting the order, the customer can print out the order data or save it locally.\n <\/p>\n

    12 Place of jurisdiction and applicable law<\/h2>\n

    \n The following applies to contracts with entrepreneurs: The place of jurisdiction is the registered office of the provider.
